Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Selfinity platform ("Service"), operated by Selfinity AI Limited (Company No. 16974440), a company registered in England and Wales with its registered office at Lytchett House, 13 Freeland Park, Wareham Road, Poole, Dorset, BH16 6FA ("Company", "we", "us", or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old to use the Service. By creating an account, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

2. Account Registration

To use the Service, you must sign in using Google OAuth. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorised access or use.

3. Description of Service

Selfinity is an AI-powered interview assistance platform that enables users to schedule, run, and review practice interview sessions. The Service includes real-time AI chat, screen sharing, audio transcription, file upload and AI-powered document retrieval, and analytics features. The AI-generated responses are for practice and educational purposes only and do not constitute professional career advice.

4. Credits and Payments

The Service offers free and paid tiers. Paid access is provided through credit purchases. Payments are processed by Stripe. By purchasing credits, you authorise us to charge your payment method accordingly.

4.1 Credits

Credits are purchased as one-off transactions and are consumed when you use paid features of the Service. Credits do not expire while your account remains active.

4.2 Cooling-Off Period and Refunds

In accordance with the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013:

4.3 Price Changes

We reserve the right to change credit pricing at any time. Price changes do not affect credits already purchased.

6.1 Permitted Files

The Service allows you to upload files in the following formats: PDF, DOC, DOCX, and TXT. We reserve the right to reject files that exceed size limits or are in unsupported formats.

You are solely responsible for the content of files you upload to the Service. You represent and warrant that:

Uploaded files are stored in cloud storage, processed into vector embeddings for AI-powered search, and relevant portions may be sent to our AI provider (currently OpenAI) during interview sessions to provide contextual responses. Full details of file processing are set out in our Privacy Policy. By uploading a file, you acknowledge and agree to this processing.

6.4 File Deletion

You may delete uploaded files at any time through the Service. Deletion removes the original file from cloud storage, its vector embeddings from our database, and associated metadata. Upon account termination, all uploaded files are deleted in accordance with our data retention policy.

7. Intellectual Property

The Service, including its design, code, AI models, branding, and documentation, is owned by Selfinity AI Limited and protected by intellectual property laws. You retain ownership of the content you upload or create through the Service (such as uploaded files and chat messages). By using the Service, you grant us a limited, non-exclusive, royalty-free licence to store, process, embed, and transmit your content solely as necessary to provide the Service. For uploaded files, this licence terminates when you delete the file or your account.

8. AI-Generated Content

The Service uses third-party AI models to generate responses. Your data sent to AI providers via API is not used for model training. We do not guarantee the accuracy, completeness, or suitability of AI-generated content. You acknowledge that AI outputs may contain errors and should not be relied upon as the sole basis for important decisions.

9. Data and Privacy

Your use of the Service is also governed by our Privacy Policy and Cookie Policy, which describe how we collect, use, and protect your personal data and how we use cookies and similar technologies.

10. Service Availability and Modifications

We strive to provide reliable access to the Service but do not guarantee uninterrupted or error-free operation. We reserve the right to modify, suspend, or discontinue any part of the Service at any time. We will make reasonable efforts to notify you of material changes.

11. Limitation of Liability

To the maximum extent permitted by applicable law, Selfinity AI Limited and its directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service. Our total aggregate liability shall not exceed the amount you have paid us in the 12 months preceding the event giving rise to liability.

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by English law.

12. Termination

You may close your account at any time by contacting us at support@selfinity.ai. We may suspend or terminate your access to the Service at our discretion if we believe you have violated these Terms. Upon termination, your right to use the Service ceases immediately. If we terminate your account without cause, any remaining unused credits will be refunded pro-rata at the rate at which they were originally purchased.

13. Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales.

14. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you by email or through the Service at least 14 days before the changes take effect. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and Selfinity AI Limited regarding the Service and supersede all prior agreements, understandings, and communications.
